Welcome to Forever Page. These Terms and Conditions (“Terms”) govern your access to and use of the website located at foreverpage.ca (the “Site”) and the custom wedding website and event management services provided by Forever Page (“we,” “us,” or “our”).

By accessing our Site or purchasing our services, you (“Client,” “you,” or “your”) agree to be bound by these Terms. Please read them carefully before proceeding with our services.

1. Services Provided

Forever Page provides high-end, custom-designed wedding websites and event technology solutions. Our services include, but are not limited to:

• Bespoke website design utilizing our signature themes (e.g., Classic Romance, Modern Minimal, Editorial Elegance).
• Integrated Smart RSVP management systems featuring personalized guest links.
• Event scheduling, travel information displays, and registry integration.
• Password-protected guest access and administrative dashboards for guest tracking.
• Full mobile optimization and hosting services.

2. Client Responsibilities and Account Security

To utilize our services, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of any administrative credentials or guest access passwords provided to you. You agree to notify Forever Page immediately of any unauthorized use of your dashboard or website.

3. Data Collection and Privacy

In providing our services, we collect information as follows:

• Client Information: Generic contact information (name, email, billing details) required to manage your account and deliver services.
• Guest Information: To facilitate the Smart RSVP system, you will provide Forever Page with guest lists, including names and contact details.
• Data Warranty: By providing guest information, you represent and warrant that you have obtained the necessary consent from your guests to share their data with us for the sole purpose of managing your wedding event and communications.
• Use of Data: We use this information strictly to populate your custom website, manage RSVPs, and provide analytics on your dashboard. We do not sell guest data to third parties.

4. Intellectual Property

• Our Property: All templates, themes (including Classic Romance, Modern Minimal, and Editorial Elegance), software code, Smart RSVP technology, and design elements created by Forever Page remain the exclusive intellectual property of Forever Page.
• Your Content: You retain ownership of all personal photos, text, and specific event details you upload to your website (“User Content”). You grant Forever Page a non-exclusive, royalty-free license to host, display, and distribute your User Content solely for the purpose of operating your wedding website.
• Limited License: We grant you a limited, non-transferable license to use the Forever Page platform for your personal wedding event. You may not resell, reproduce, or reverse-engineer our design themes or RSVP systems.

5. Fees and Payment

All fees for services are outlined at the time of purchase. Access to the dashboard and the launch of the custom website are contingent upon receipt of full payment. All payments are processed securely, and fees are non-refundable once the custom design process has commenced, given the bespoke nature of our services.

6. Prohibited Conduct

You agree not to use the Site or your custom website to:

• Upload or transmit any content that is unlawful, offensive, or infringes on the rights of others.
• Attempt to bypass the Smart RSVP security or gain unauthorized access to other clients’ data.
• Use the platform for commercial solicitation or spamming guests.

7. Limitation of Liability

Forever Page provides its services on an “as-is” and “as-available” basis. While we strive for perfection in every digital experience, we do not guarantee that the service will be entirely error-free or uninterrupted. To the maximum extent permitted by law, Forever Page shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use our services, including but not limited to technical guest errors or data loss.

8. Indemnification

You agree to indemnify and hold harmless Forever Page and its owners, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from your User Content, your breach of these Terms, or your violation of any third-party rights (including privacy rights of your guests).

9. Termination

Forever Page reserves the right to terminate your access to the services if you violate these Terms. Upon the conclusion of your wedding event (and any subsequent hosting period agreed upon), your website may be deactivated and your data archived or deleted in accordance with our data retention policies.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
